The Kerala High Court has issued an order preventing the use of Artificial Intelligence (AI) tools in the issuance of judicial orders. Specific directives have been given to judicial officers and all relevant parties to this effect. The court has clearly stated that cloud-based AI platforms, including ChatGPT, are prohibited from being used in the process of issuing orders, and any violation of these instructions will result in severe action. This directive further stipulates that AI should not be used to render judgments or orders, or to form any judicial conclusions. The High Court is highlighting the necessity for caution in light of the risk of inaccuracies associated with AI tools. Appropriate training, which can be gained via programs run by the Judicial Academy or the High Court, is recommended. Moreover, if AI tools are utilized, they must be approved tools, and monitoring must be conducted at every phase. Any technical problems or malfunctions detected in the AI tools should be immediately reported to the IT Department of the High Court. This ruling comes after the High Court overturned reforms to driving license exams implemented by the State Transport Commissioner, following objections from driving schools.
