
A strong debate has emerged regarding the 130th Amendment Bill, with Union Home Minister Amit Shah accusing the opposition of hypocrisy. Shah specifically criticized the Congress party for its alleged history of placing Prime Ministers above the law. He contrasted this with the BJP’s policy of ensuring legal accountability for all its leaders, including the Prime Minister. Shah pointed out that Indira Gandhi had previously amended the constitution to protect herself from legal action.
Shah introduced constitutional amendment bills in the Lok Sabha. These bills aim to prevent individuals from holding key constitutional positions (Prime Minister, Chief Minister, and ministers) while incarcerated. The proposed laws aim to enhance ethics in politics.
The key provisions include:
1. Preventing incarcerated individuals from holding positions of Prime Minister, Chief Minister, or ministers.
2. Acknowledging the potential issue of leaders continuing in office after arrest, a scenario unforeseen by the constitution’s original drafters.
3. Requiring arrested leaders to obtain bail within 30 days or face removal from office, with reinstatement possible upon subsequent bail.
Shah stated that while PM Modi is promoting accountability by bringing this amendment, the Congress-led opposition is opposing it to shield themselves from legal consequences. He referenced the 39th Constitutional Amendment enacted by Indira Gandhi, granting the Prime Minister special immunity. Responding to personal criticism from a Congress leader, Shah clarified that he resigned before his arrest in a case that was later deemed politically motivated. He emphasized he didn’t hold any constitutional position until the court cleared him.
Shah also stated that the BJP and NDA uphold ethical standards, referencing LK Advani’s resignation due to mere accusations. He criticized the Congress for continuing what he saw as unethical practices. He highlighted that the opposition continues to resist the bill despite it being sent to a joint parliamentary committee, revealing their agenda to the public.
