However, the order suggests that prosecution may still be pursued if the act of flag burning triggers substantial societal unrest. The court, in a 5-4 decision, affirmed that the First Amendment protects flag burning as a form of political expression. Justice Antonin Scalia, a well-known conservative, was part of the majority in that ruling.
On Monday, Trump asserted that flag burning is a catalyst for riots and societal disturbance. He underscored that the act can provoke violent reactions from those who are offended. According to Trump, the burning of a flag can cause widespread chaos, with many people resorting to violence.

It also outlines that foreign nationals involved in flag burning may face the revocation of their visas, residency permits, citizenship processes, and other immigration privileges, potentially leading to deportation.
